Terms of Service

You need to register an account to access the full functionality of the Platform. When registering, you must provide truthful, accurate, and complete information, and keep such information updated thereafter.

You are responsible for maintaining the confidentiality of your account password. You may not lend, transfer, or permit others to use your account. If you suspect unauthorized use of your account, notify us immediately.

Accounts inactive for more than 180 consecutive days may be frozen or terminated. Violation of these Terms may result in account suspension or permanent ban.

The primary content on the Platform consists of AI-generated comic works. Users may create, upload, share, and browse AI comics on the Platform.

Content you upload to the Platform, including comics, comments, images, text, and other materials ("User Content"), remains your property. By uploading content, you grant us a non-exclusive, worldwide license to display, distribute, promote, and reasonably use such content for the purpose of operating and improving our Services.

Due to the nature of generative AI technology, content on the Platform may not always be accurate, consistent, or meet specific quality standards. AI comics content on the Platform does not reflect the views or positions of GarbageCan.

You may not:

• Upload content that violates applicable laws of Canada or your country of residence
• Post pornographic, violent, hateful, discriminatory, or other inappropriate content
• Infringe upon the intellectual property rights, privacy rights, or other legal rights of others
• Use bots, crawlers, or other automated tools to scrape Platform data
• Engage in any conduct that disrupts Platform operations or security
• Impersonate others or create fake accounts
• Use the Platform for money laundering, fraud, terrorist financing, or other illegal activities
• Commercially exploit others' works without authorization

If you discover content that violates these Terms, you may report it through the reporting features provided on the Platform. We will review and take appropriate action within a reasonable timeframe.

Copyright-specific reports: Claims of copyright infringement must be submitted through the formal Takedown Notice process described in our Copyright Policy, not through general reporting features. This ensures your claim receives proper legal review and documentation under applicable copyright law.

False reporting: Intentionally submitting false or misleading reports may result in account suspension or termination.

The GarbageCan name, logo, interface design, software code, technical architecture, and related intellectual property rights are owned by us. No copying, modification, distribution, or reverse engineering of the Platform software is permitted without our prior written authorization.

You retain ownership of content you publish on the Platform. By uploading content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, distribute, promote, and reasonably use such content for the purpose of operating and improving our Services. This license terminates when you delete your content or your account, except to the extent your content has been shared with other users (e.g., via community features) and they have not deleted it.

AI comics creation involves generative artificial intelligence technology. Due to the nature of AI models, different users may generate similar content, which is a normal technical occurrence. You understand and accept that AI comics content may not be unique.

Respect for Copyright. GarbageCan respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with applicable law.

Our Role. As an online service provider hosting user-generated and AI-generated content, we rely on the safe harbor protections available under the Copyright Act of Canada, the Digital Millennium Copyright Act (17 U.S.C. § 512) of the United States, and Regulation (EU) 2022/2065 (Digital Services Act) of the European Union, as applicable.

Copyright Policy Reference. Our full Copyright Policy—including procedures for submitting Takedown Notices, filing Counter-Notifications, and our Repeat Infringer Policy—is published at garbagecan.com/copyright and is incorporated into these Terms by reference. You should review it carefully before uploading content.

In accordance with applicable law and our Copyright Policy, GarbageCan will, in appropriate circumstances, terminate the accounts of users who are repeat infringers. Specifically:

A "valid infringement" means a Takedown Notice that has been reviewed and substantiated by us in accordance with our Copyright Policy, and against which no successful Counter-Notification has been filed. Users whose accounts are terminated under this policy forfeit any remaining VIP membership, creator earnings balance, or other account benefits.

By uploading content to the Platform, you represent and warrant that:

1. You own the content or have the necessary licenses, rights, consents, and permissions to upload it and grant the license described in Section 6.2;
2. The content does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party;
3. The content complies with these Terms and all applicable laws.

Without limiting the general indemnification in Section 13, you specifically agree to indemnify, defend, and hold GarbageCan harmless against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from any allegation that content you uploaded infringes the intellectual property rights of a third party.

VIP members are entitled to the following benefits (subject to actual Platform offerings):

• Ad-free experience
• Exclusive content and early access
• Priority customer support
• Other member-exclusive features

VIP membership fees are payable as a one-time payment for lifetime access (or as per the then-current pricing plan). Once payment is completed, refunds are not available except as required by applicable law.

We reserve the right to adjust membership benefits and pricing. Material changes will be notified to existing members in advance.

Any user may become a creator and upload works. Creators must comply with these Terms and any additional Creator Program rules.

Creators may earn revenue from their works in accordance with the Creator Program rules. Specific revenue share percentages and withdrawal rules are as displayed on the Creator Program page.

Creators who meet the minimum withdrawal threshold may request earnings withdrawal. Withdrawal requires completing identity verification (KYC) and compliance with applicable anti-money laundering laws and regulations, including Canada's Proceeds of Crime (Money Laundering) and Terrorist Financing Act. We reserve the right to review and delay withdrawals.

You may delete your account and cease using the Platform at any time. Upon deletion, these Terms terminate, except that Sections 6 (Intellectual Property), 11 (Disclaimer), 12 (Limitation of Liability), 13 (Indemnification), and 16 (General) shall survive.

If you violate these Terms, we reserve the right to suspend or terminate your account with or without notice, at our sole discretion.

These Terms constitute the entire agreement between you and us, superseding any prior oral or written agreements regarding the Platform.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which the Platform operator is domiciled, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiation. If negotiation fails, the parties agree to submit to the exclusive jurisdiction of the courts located in the province where the Platform operator is domiciled in Canada. The parties shall use their best efforts to resolve disputes through mediation or arbitration before initiating litigation.
